Data protection at www.cemec.de

Data protection is a matter of trust, and your trust is important to us. We respect your privacy and personal sphere. Therefore, we observe the legal regulations when processing your personal data. We would like to inform you here about our data collection and data usage.

I. What do we do with your personal data?

1. Inquiries, contract processing

Personal data is information about factual or personal circumstances of a specific or determinable natural person. This includes, for example, the name of contact persons or, in the case of sole proprietorships, the name, your telephone number, your address, e-mail addresses, and all inventory data that you provide to us. We collect and process your data for processing your inquiries or the preparation, execution, and termination of contracts as well as any later warranty settlements.

2. Applications

We process the applicant data only for the purpose and within the scope of the application procedure in accordance with the legal requirements. The processing of applicant data takes place to fulfill our (pre-)contractual obligations within the application procedure in the sense of Art. 6 Para. 1 lit. b. GDPR Art. 6 Para. 1 lit. f. GDPR if the data processing is necessary for us, e.g., within the scope of legal proceedings (in Germany, § 26 BDSG also applies).

The application procedure requires that applicants provide us with the applicant data. The necessary applicant data are marked, if we offer an online form, otherwise result from the job descriptions and basically include the information on the person, postal and contact addresses and the documents belonging to the application, such as cover letter, curriculum vitae and certificates. In addition, applicants can voluntarily provide us with additional information.

By submitting the application to us, the applicants agree to the processing of their data for the purposes of the application procedure in accordance with the type and scope set out in this privacy policy.

Insofar as special categories of personal data within the meaning of Art. 9 Para. 1 GDPR are voluntarily communicated within the scope of the application procedure, their processing takes place additionally in accordance with Art. 9 Para. 2 lit. b GDPR (e.g., health data, such as severe disability or ethnic origin). Insofar as special categories of personal data within the meaning of Art. 9 Para. 1 GDPR are requested from applicants within the scope of the application procedure, their processing takes place additionally in accordance with Art. 9 Para. 2 lit. a GDPR (e.g., health data, if these are necessary for the exercise of the profession).

If provided, applicants can submit their applications to us via an online form on our website. The data is transmitted to us in encrypted form in accordance with the state of the art.

Furthermore, applicants can send us their applications via e-mail. However, we would like to point out that e-mails are generally not sent in encrypted form and the applicants themselves must ensure encryption. We can therefore not assume any responsibility for the transmission path of the application between the sender and the receipt on our server and therefore recommend using an online form or postal dispatch. Because instead of applying via the online form and e-mail, applicants still have the option of sending us the application by post.

The data provided by the applicants can be further processed by us in the event of a successful application for the purposes of the employment relationship. Otherwise, if the application for a job offer is not successful, the data of the applicants will be deleted. The data of the applicants will also be deleted if an application is withdrawn, which the applicants are entitled to do at any time.

The deletion takes place, subject to a justified revocation of the applicants, after the expiry of a period of six months, so that we can answer any follow-up questions about the application and meet our obligations to provide evidence under the Equal Treatment Act. Invoices for any reimbursement of travel expenses will be archived in accordance with tax regulations.

3. Advertising

We would like to point out that, to the extent legally permissible without your separate, express consent, we use your data – also repeatedly – for our own advertising and marketing purposes.

In particular, we reserve the right to store your first and last name, your postal address and – if we have received this additional information from you within the scope of the contractual relationship – your title, academic degree, year of birth and your professional, Industries or business designation in summarized lists and to use them for our own advertising purposes, e.g. to send you interesting offers and information about our products by letter post. In addition, we also use the telephone number for advertising purposes in the event of presumed consent. You can object to the storage and use of your data for these purposes at any time by sending a message to the contact option described below.

4. Deletion

Data of interested parties will be deleted after three months if the inquiries are not stored for an impending contractual relationship at a later date. Deletion will take place no later than two years if a contractual relationship has not been realized.

Personal data relating to contractual relationships will be deleted at the earliest when the contracts have been terminated, fully processed, and further claims have become statute-barred. Deletion in this sense initially means that your data will be blocked for marketing activities in our systems. The data will – if necessary – continue to be archived within the framework of commercial and tax documentation for the duration of the retention periods.

II. Is data collected when you visit our site?

1. Cookies

We use so-called cookies on our website. Cookies are small files that are stored on your data carrier and that store certain settings and data for exchange with our system via your browser. This storage helps us to design the website accordingly for you and makes it easier for you to use, for example, by storing certain entries from you so that you do not have to repeat them constantly. Cookies are automatically deleted from your hard drive after the end of the browser session (end of the session) (hence also session cookies). But there are also cookies that remain on your hard drive. The expiry time is set far in the future for your convenience. On a further visit, it is then automatically recognized that you have already been with us and which entries and settings you prefer. (so-called long-term cookies).

Your protection option

Regardless of the set duration, you can also manually delete cookies in your browser. Most browsers accept cookies by default. You can allow or prohibit temporary and stored cookies independently of each other in the security settings. Apart from a browser setting that generally deactivates the automatic setting of cookies, you can also deactivate cookies by setting your browser so that cookies from a specific domain, e.g. “googleadservices.com”, are blocked. This setting then prevents the execution of corresponding services that set cookies from this domain.

Some web services work with opt-out cookies. The set cookie then recognizes, for example, a web analysis service that you do not want to be recorded. If you delete all cookies, remember that you may have to make corresponding settings again.

Accepting cookies is not a prerequisite for visiting our online offer. If you do not accept or deactivate cookies, certain options (e.g. services and information) on our site may not be available to you and some websites may not be displayed correctly.

Further information about the use of cookies can be found on the pages of the German Association for the Digital Economy (BVDW) e.V. (www.meine-cookies.org).

Please also note our information on the use of cookies for the individual services whose use we have listed and explained under web analysis and advertising.

2. Web analysis

You can visit our site without providing any information about yourself. When you visit our websites, even if this happens, for example, via a link in a newsletter or an advertisement, certain data is nevertheless collected and stored. We only store access data without personal reference such as e. g.

  • the website from which you visit us
  • Type of your browser
  • the name of your Internet Service Provider
  • the name of the requested file
  • Products and content in which the visitor is interested

and use data which has been stored via the cookies explained above. This data is evaluated to improve our offer and does not allow us to draw any conclusions about your person. Only if you have given us your consent separately, we store such data about your person and use the data exclusively for offers and information adapted to your interests as much as possible.

The evaluation of the data without your consent is otherwise only carried out in anonymous or pseudonymous form (e.g.: Information xy was accessed by 45% of the visitors to the page). This enables us to tailor our information offers to the interests of the readers.

Where we learn of a date which theoretically allows conclusions to be drawn about your person, such as the IP address, we store this only for a short time (max. 7 days) for purposes of system security, abuse prevention and defense.

If we include third-party content on our pages (e.g. embedded films or other information), they will receive your IP address for this purpose alone, as otherwise the content cannot be delivered to your browser.

3. Google Analytics (anonymization function)

The controller has integrated the Google Analytics component (with anonymization function) on this website. Google Analytics is a web analysis service. Web analysis is the collection, compilation, and evaluation of data about the behavior of visitors to websites. A web analysis service collects, among other things, data on which website a data subject has come to a website from (so-called referrer), which subpages of the website were accessed or how often and for how long a subpage was viewed. Web analytics is mainly used to optimize a website and to analyze the cost-benefit of online advertising.

The operating company of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

The controller uses the addition “_gat._anonymizeIp” for web analysis via Google Analytics. By means of this addition, the IP address of the Internet connection of the data subject is shortened and anonymized by Google if the access to our Internet pages takes place from a member state of the European Union or from another contracting state of the Agreement on the European Economic Area.

The purpose of the Google Analytics component is to analyze the flow of visitors on our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us that show the activities on our website, and to provide other services related to the use of our website.

Google Analytics sets a cookie on the information technology system of the data subject. What cookies are has already been explained above. By setting the cookie, Google is enabled to analyze the use of our website. Through each call to one of the individual pages of this website, which is operated by the controller and on which a Google Analytics component has been integrated, the Internet browser on the information technology system of the data subject is automatically caused by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. As part of this technical process, Google obtains knowledge of personal data, such as the IP address of the data subject, which Google uses, among other things, to trace the origin of visitors and clicks and subsequently to enable commission settlements.

By means of the cookie, personal information, such as the access time, the location from which an access originated and the frequency of visits to our website by the data subject, is stored. With each visit to our website, this personal data, including the IP address of the Internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may pass on this personal data collected via the technical process to third parties.

The data subject can prevent the setting of cookies by our website, as shown above, at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a cookie on the information technology system of the data subject. In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs.

Furthermore, the data subject has the possibility to object to and prevent the collection of data generated by Google Analytics, which relates to the use of this website, as well as the processing of this data by Google. For this purpose, the data subject must download and install a browser add-on under the link https://tools.google.com/dlpage/gaoptout. This browser add-on informs Google Analytics via JavaScript that no data and information about visits to websites may be transmitted to Google Analytics. The installation of the browser add-on is considered by Google as an objection. If the data subject’s information technology system is deleted, formatted, or reinstalled at a later time, the data subject must reinstall the browser add-on to disable Google Analytics. If the browser add-on is uninstalled or deactivated by the data subject or another person attributable to their sphere of control, it is possible to reinstall or reactivate the browser add-on.

Further information and the applicable data protection provisions of Google can be found at https://www.google.de/intl/de/policies/privacy/ and at https://www.google.com/analytics/terms/de.html. Google Analytics is explained in more detail under this link https://www.google.com/intl/de_de/analytics/

III. How do we protect your personal data?

Your personal data is transmitted securely by encryption. We use the coding system SSL (Secure Socket Layer). We secure our website and other systems through technical and organizational measures against loss, destruction, access, modification, and distribution of your data by unauthorized persons. You should always treat your access information confidentially and close the browser window when you have finished communicating with us, especially if you share the computer with others.

IV. What rights do I have?

You have the right to object to the use of data for advertising purposes and to the creation of user profiles when using pseudonyms.

According to the Federal Data Protection Act, you have, among other things, a right to free information about your stored data and, if applicable, a right to correction, blocking or deletion of data. If you have any questions regarding the collection, processing or use of personal data, for information, correction, blocking or deletion of data, simply contact us via the contact details listed at the end of these notes.
